What is a car accident in Ukraine?

Under Ukrainian legislation, a car accident is an event that occurs during the movement of a vehicle and causes either death or injury to people, or material damage. In addition, alcohol consumption before driving is a significant issue in Ukraine, as well as the lack of enforcement of traffic laws. Despite efforts to improve road safety, including the introduction of new traffic laws and increased police presence on the roads, car accidents remain a serious problem in Ukraine.

What to do when you have a car accident in Ukraine?

  1. The first thing to do is to check if there are any injuries to the driver (s) and passengers. It is compulsory to provide first medical assistance if required. Use a first aid kit (in Ukraine, all cars are required to have one, as it’s mandatory under the legislation). Call an ambulance only if it’s necessary. Suppose it is impossible to provide medical assistance to the victim. In that case, the victim should be taken to the nearest medical facility, having previously recorded the location of the accident and the position of the vehicle after it stopped. At the same time, you must provide your name and license plate number (with a driver’s license or another identification document, vehicle registration document) and return to the place of the car accident.
  2. Put warning triangle (s) and take all required actions to make sure that this car accident will not cause any other accidents or disadvantages (as much as it is possible).
  3. Decide whether call the police or not because, in some cases, it might not be required. Drivers have the right to make so-called Euro-protocol if the damages are not big and if there are no health injuries due to the car accident. This can be done only if both drivers agree on it and (the main) that both have agreed on how it will be conducted. Consider that to be able to make Euro-protocol, both parties of the accident shall have valid civil responsibility insurance. In case if there is no consent, then it is required to call the police.
  4. It is extremely important that all events at the scene of a traffic accident are recorded carefully, thoroughly, clearly, and without errors. Therefore, one of the key tasks of a driver in an accident is not to move the vehicle and objects involved in the accident. The actions of drivers in an accident should be aimed primarily at preserving the integrity of the accident scene. If someone violates the state of affairs or tries to hide something, it is necessary to intervene and prevent illegal actions. Also, actions at an accident allow for video recording and photos of all important details. Police officers should record everything that will help establish the circumstances of the events preceding the accident and their exact development.

What are the rights and obligations of the Police during car accidents in Ukraine?

The police officers who arrive at the scene will prepare a list of documents, including a report on the inspection of the accident scene, a report on the condition of the vehicles, a schematic representation of the development of the events, and statements of witnesses and participants.

There are certain legal actions of Ukrainian road Police when they arrive at the place of a car accident:

  • police have the right to take the driver’s license, car document, and civil responsibility insurance to check and to keep the mentioned documents till the end of the proceedings;
  • policeman shall make a scheme for the accident and draft the protocol;
  • a policeman takes the final decision regarding the car accident; it is a policeman to decide who is guilty as of the moment when the car accident protocol is conducted;
  • police are authorized to check the driver if they suspect that a driver is under the influence of alcohol or drugs or (if they don’t have the required tools) send the driver to the hospital to make expertise.
